Former Guelph taxi company granted judicial review of decision to pull its licence

A former Guelph taxi company has been granted a judicial review of the decision to revoke its licence last year.

Guelph Taxi Inc. operated a handful of taxis out of an office on Willow Road for roughly two years, focusing primarily on a mobility service for wheelchair customers.

Its licence was revoked by the Guelph Police Service in September of 2015.

The reason given at the time by Guelph Police Chief Jeff DeRuyter was that the company was not meeting the bylaw requirement that licenced cab companies in Guelph be staffed 24 hours a day, seven days a week.

The company appealed to the Guelph Police Services Board but the decision was upheld.

Guelph Taxi Inc. has been fighting a legal battle against the decision since and has now been granted a judicial review of the decision by the Ontario Superior Court of Justice.

It will not be allowed to resume operations while the judicial review is taking place.

"The licence revocation ordered by the Chief of Guelph Police stands," says the ruling, issued Nov. 2.

"The Applicant's application is granted. The Guelph Police Services Board's decision is set aside and a new appeal ordered," it also reads.

Guelph Taxi was informed Sept. 22, 2015, by the Guelph Police Service, who were responsible for taxi licencing at the time, that it was losing its licence immediately.

Guelph Taxi was previously unsuccessful in an attempt to be allowed to keep operating while the judicial review granted Nov. 2 was being considered.

A lengthy media release sent by Guelph Taxi Inc. in regards to the most recent decision upheld its claims that it was unfairly treated and that it lost their licence in part because it opposed tariff increases.

Guelph Taxi also claims that the decision is in violation of Ontario's Accessibility for Ontarians With Disabilities Act.

The phone number contained in the press release is no longer in service and email attempts for further comment from Guelph Taxi Inc. were not immediately returned.
