Fail to provide breath sample charge

CENTRE WELLINGTON TOWNSHIP – On July 2, 2016 at approximately 8:51 p.m. members of the Wellington County Ontario Provincial Police (OPP) were conducting R.I.D.E. spot checks on Wellington Road 29 near the Guelph-Eramosa - Garafraxa Townline in Centre WellingtonTownship.

Officers observed a 2011 Mercedes travelling southbound towards the checkpoint and then abruptly turn right into the parking lot of a business.

Officers observed the male driver and the female passenger switch seats. 

Officers approached the male driver and while speaking with him, police detected the odour of alcohol on his breath. 

The male confirmed that he had consumed alcohol earlier.  An Approved Roadside Screening Device test demand was read however, the driver failed to provide a suitable breath sample after several opportunities and was placed under arrest.

His driver’s licence has been suspended for 90 days and the vehicle impounded for a period of seven days as per statute.

62-year-old Danielo Soriano of Scarborough has been charged with Fail to Provide Breath Sample contrary to the Criminal Code of Canada. He is to appear in Guelph Criminal Court on July 15, 2016 to answer to the charge.
