Guelph man charged after refusing roadside test

Police spoke with the driver and detected a strong odour of alcohol on their breath

(TOWNSHIP OF CENTRE WELLINGTON, ON) - On May 23, 2020 at approximately 1:55 a.m. a member of the Wellington County Ontario Provincial Police (OPP) investigated the driver of a motor vehicle on St. David Street south and St. Andrew St. east for a Highway Traffic Act (HTA) violation.

Police spoke with the driver and detected a strong odour of alcohol on their breath. A Roadside Screening Device test demand was read which the driver refused to comply with and they were placed under arrest. The driver refused to sign the release documents and was subsequently held in custody for a bail hearing.

Ryan Louis WEBER, 42-years-old of Guelph has been charged with Failure or Refuse to Comply with Demand contrary to the Criminal Code, Have Care and Control of Motor Vehicle With Open Container of Liquor contrary to the Liquor Licence Act, Red Light - Proceed Before Green contrary to HTA and Operate Motor Vehicle - No Insurance contrary to the Compulsory Automobile Insurance Act.

The vehicle was impounded for seven days and driver's licence suspended for 90 as per statute.
