Second brother accused in murder of Nick Tanti appears in bail court

It will be Wednesday before a decision is announced on whether the second of two brothers accused in the murder of Nick Tanti will be released on bail.

Aidan Kee was present at bail court Friday at the Superior Court of Justice on Woolwich Street, seeking bail in his first-degree murder charge in the death of Tanti.

His younger brother Angus, who also stands accused in the murder, was released May 22 on a $75,000 no-deposit bail to a surety with a number of conditions. The brothers are under strict conditions to not communicate with one another.

Tanti died Feb. 29 of a stab wound following what police said was an altercation involving three men outside Tony's Billiards on Macdonell Street at roughly 2 a.m.

Tanti died shortly after the incident in hospital and the Kee brothers were located by police nearby a few minutes later.

At Friday's hearing, Aidan appeared in grey pants and an orange T-shirt, with a blue face mask and a face shield.

Although the courtroom was open to the public, only 13 people were allowed to sit in the gallery due to physical distancing requirements put in place in response to COVID-19.

The courtroom gallery was split with supporters of Kee on one side and the family of Tanti on the other.

Plexiglass screens have been put in place throughout much of the room and face masks were worn throughout the proceedings, except by those speaking.

At the beginning of the hearing, Justice Nancy Mossip asked members of Tanti’s family to cease holding up framed photographs of the slain man.

Mossip placed a a publication ban on Friday's four-hour long bail hearing under section 517 of the Criminal Code. As a result, any evidence that may have been presented during the hearing can not be shared by media.

Crown attorney Julia Forward and Aidan’s defence attorney, James Miglin, each presented arguments over whether bail should be granted for the 26-year-old.

Mossip said her decision on whether or not bail will be granted will be shared with the attorneys on Tuesday to help prepare with Aidan’s possible release and presented in open court on Wednesday at noon.

After the hearing, Aidan was transported back to Maplehurst Correctional Complex, where he is currently being held.
