SIU terminates Guelph investigation after injured man declines to participate

MISSISSAUGA – The Director of the Special Investigations Unit, Joseph Martino, has terminated an investigation in Guelph.

On June 4, 2021, the Guelph Police Service (GPS) notified the SIU of possible fractured ribs having been sustained by a 43-year-old man in the course of his arrest by GPS officers on April 16, 2020. The injuries had come to the attention of the police service at one of the man’s court appearances. The SIU initiated an investigation.

Based on the SIU’s preliminary inquiries, the SIU Director, Joseph Martino, concluded that the investigation should be discontinued at this time. The man has made it clear that he does not wish to participate in an investigation. In the absence of an interview with the man and a review of his medical records, there is an insufficient evidentiary foundation from which to proceed with an investigation.

Every consideration will be given to re-opening the file should the man decide to come forward in the future.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians.
