Local high school teacher pleads guilty to four sex-related charges

Two of the crimes involved a student, two others were against former students

A Guelph high school teacher pleaded guilty to four sex-related offences in a Guelph courtroom on Wednesday.

Brian Hathway, 50, was originally charged in 2017 with eight sex-related charges. The victims include one minor who was a student of his at the time and two former students who were not minors.

Hathway was an auto body teacher at College Heights Secondary School, starting there in 2003. He was placed on leave while the charges were being dealt with.

On Tuesday Hathway pleaded guilty to the following charges:

  • Sexual assault and sexual exploitation of a minor

  • Sexual assault

  • Communicating with a person for obtaining sexual services

He will be sentenced on March 8.

The Upper Grand District School board issued the following statement following the guilty plea: "Mr. Hathway was removed from the school on September 7, 2017. In light of this new information, the board will immediately review Mr. Hathway’s employment status. The health and well-being of our students have been and remain our top priority."

Hathway was originally arrested on Sept. 11, 2017, and charged with three of the offences. As the investigation progressed, he was charged with five more.

Crown attorney Julia Forward offered details of the crimes:

The first involved a minor who went to Hathway’s house on several occasions between June 1, 2016, and Sept. 11, 2017. The student drank alcohol with the teacher and smoked marijuana. Hathway also give the male student money and expensive clothing.

“To start with he just gave them as gifts and eventually there were strings attached and the victim was required to engage in intimate sexual behaviour with him on his love seat,” Forward said.

That involved kissing while the accused rubbed his erect penis against the victim.

The second victim drank at Hathway’s house, where his former teacher asked him for sexual favours while rubbing his hand on his thigh. There were also other graphic sexual favours requested.

The third victim attended Hathway’s house and drank with him. When the victim went to the bathroom he washed his hands then turned around to find Hathway on his hands and knees in the bathtub, asking to be urinated on.

“The complainant thought that was a joke,” Forward said, and left the room.

Later downstairs Hathway put money on the table and asked the victim to perform oral sex on him for money. The amount offered was continually raised until it reached $360, Forward said.

Hathway has been out on bail pending the resolution of his case.
