Driving infraction leads to impaired charges

Investigation leads officers to suspect driver of drinking and conduct a roadside screening device test

TOWNSHIP OF GUELPH-ERAMOSA - On Dec. 6, 2019, at approximately 3:40 a.m. the Wellington County Ontario Provincial Police (OPP) investigated the driver of a motor vehicle on Wellington Road 29 near Indian Trail for a Highway Traffic Act violation.

During the course of the investigation, officers formed the opinion that the driver had been consuming alcohol. A roadside screening device test was conducted which resulted in a fail.

The driver was arrested and brought to a local OPP operations centre for further testing. While searching the vehicle incident to arrest officers seized marijuana and an open container of alcohol.

Charles Earl Bixby, 28 years old, of Hamilton, has been charged with Impaired Operation - 80 Plus (mg of alcohol per 100 mL of blood) contrary to the Criminal Code, Speeding contrary to the Highway Traffic Act, Drive Motor Vehicle with Liquor Readily Available contrary to the Liquor Licence Act and Drive Motor Vehicle with Cannabis Readily Available contrary to the Cannabis Control Act 2017.

A 90-day Administrative Driver's Licence Suspension (A.D.L.S.) and seven-day vehicle impoundment was initiated as per statute. The accused is scheduled to appear in the Ontario court of justice - Guelph on Jan. 7, 2020.
