Vehicle in ditch leads to impaired charges for Guelph driver

Accused was also prohibited from driving, police say

TOWNSHIP OF GUELPH-ERAMOSA - On Nov. 15, 2020 at approximately 1:15 a.m., Wellington County Ontario Provincial Police (OPP) responded to a report of a motor vehicle that had driven into a ditch on Township Road 1 in Guelph-Eramosa Township.

Police spoke with the driver and determined that their ability to operate a motor vehicle was impaired by alcohol. Police also discovered that the driver was prohibited from driving under the Criminal Code.

The driver was placed under arrest for impaired operation and they were read the demand to provide a breath sample.

The driver later declined to provide the required samples of their breath.

Alexander Okbansie Hiyabu, 34 years old of Guelph, has been charged with operation while impaired - alcohol or drug, failure or refuse to comply with demand, and operate motor vehicle while prohibited contrary to the Criminal Code of Canada.

The accused is scheduled to appear in the Ontario court of justice - Guelph on Dec. 8, 2020.

The vehicle was impounded for 45 days and driver's licence suspended for 90 as per statute.
