After 12 attempts, man charged with not providing breath sample

Man reportedly agreed to provide sample for police but hadn't given a 'proper one' after a dozen attempts

A 48-year-old Guelph man was charged with failing or refusing to provide a breath sample on Saturday evening after he was given a dozen tries, police say.

Police responded to a call of a possible impaired driver at a plaza near Victoria Road South and Arkell Road at about 8:15 p.m. When officers arrived, a news release explains they found an SUV parked partially on the curb and, when speaking with the driver, detected an odour of alcoholic beverage on his breath.

The man reportedly agreed to provide a breath sample but failed to provide a “proper sample” even when cautioned that a criminal charge could be laid if he didn’t.

In addition to the charge, the accused had his driver’s licence automatically suspended for 90 days and his vehicle impounded for a week.
